WHAT YOU CAN DO ABOUT SLOVENIA'S PLAN TO TO KILL 106 BROWN BEARS IN YEAR 2007

The Minister of the Environment and Spatial Planning of Slovenia suggests and plans a quota of 106 bears to be killed in 2007.

Although a brown bear is an endangered animal species protected with regulations of Slovenia as well as European Union, a large number of bears are going to be killed; even mothers and their youngs - the country has no mercy. The country claims that bears cause damage, are dangerous to people and that therefore a certain number of bears must be killed. We believe there are other means of resolving all these problems. Numerous related measures are also included in the Strategy of brown bear population management, which the government of Slovenia accepted already in 2002. Bears that come to close to settlements can be chased away or taken back to the woods, a reimbursement system has been established to repair the damage, owners are also responsible to make sure that their property is protected and many other measures to improve the natural habitat of bears are envisaged. Some experiences have shown that instead of killing bears, educating people about the proper treatment of bears, coexistence with them and advising them where food waste should not be dumped can drastically reduce the number of conflicts between bears and people.

If there are to many bears, as the country claims, castration and sterilization of a part of the population or contraception should be considered. But the truth is the country does not even know the exact number of bears in Slovenia, there is only an estimation of 500 to 700 bears. However, this estimation is not supported by the leading scientists in Slovenia, who believe that there are less bears. In addition, the country itself confessed that the balanced number of bears is not known and that the appropriate number of bears in Slovenia has not been defined yet. Any interfering with internationally protected animal species, which is endangered, is weakening the species and is therefore inadmissible.

Furthermore, nature has its own mechanisms of ensuring natural balance therefore hunting and violence are not needed and are even harmful. We only have to give nature a chance. A good example are various national reserves, where no hunting takes place, and the canton of Geneva in Switzerland, where hunting was prohibited already in 1974 - and there are not any particular problems with natural (un)balance.

Various findings and studies show that killing or increased killing of animals can increase the number of conflicts and births. Therefore there is a great possibility that planned killing of bears, which includes an even larger number than the last year, will only achieve a counter effect, which is even more conflicts, damage and maybe more bears. If that happens, local inhabitants can be even in greater danger than before.

Even though the Minister of the Environment and Spatial Planning is bound by the Constitution of the Republic of Slovenia to ensure the preservation of the environment and natural habitats, he has decreed the killing of no less than 106 inhabitants of this country - for they are living beings and a part of our natural wealth. Is the killing of bears consistent with preserving this natural wealth - or is it about destroying it?

Even though any incitement to violence is unconstitutional, the Minister of the Environment himself has decreed the killing of living creatures, which will inflict immeasurable violence upon nature. And even though torture of animals is expressly forbidden by the Slovene constitution, the animals to be killed will be victims of immense suffering.

We ask you to join us in our protest against the imminent killing of bears.

We suggest that you send a protest letter to the Minister of the Environment and Spatial Planning of the Republic of Slovenia, Janez Podobnik, and to the President of the Government of the Republic of Slovenia, Janez Janša, and call upon them not to allow the killing of bears. At the same time we suggest that you call upon them to do their best to realize the nonviolent means of achieving coexistence of human with the brown bear and protection of the brown bear. You can also write to other politicians in Slovenia, e.g. the President of the State, Janez Drnovšek, and suggest them to join the protest against the killing of bears. You can even write to Slovenian Bishops and to the Pope.

Slovenian farmers started placing warning boards against hunting
In the beginning of January, Stanko Valpatic, the president of Slovenian Society for the rights and liberation of animals, placed two warning boards against hunting at the borders of his farm. The board states: There is no killing in Slovene constitution. Hunters, we summon you not to pursue and kill animals on this property! “We decided to place boards against hunting because we treat animals as equal inhabitants of the Earth, who also have the right to habitat, food and natural death. Every wild animal can step on our piece of land, to feed or build a dwelling-place, create a family and die of natural cause. In that way we wish to protect the animals, our friends, from an early death caused by hunters. If we think that way, then it will never run out of food, there will always be enough of it for everybody. So I think pursuing and killing of the animals is unnatural, unnecessary, unethical, immoral and a very vile act. And for a Christian or better said a Prechristian, it is also in a contrary with the life of Jesus, his teachings and the fifth commandment “Do not kill”, said Stanko and added that he wishes for as many farmers across Slovenia and other parts of the world as possible, to do the same thing as he did. To his suggestion already joined seven farmers, mainly from Štajerska (north-east of Slovenia) who also oppose to the hunting on their properties.


ROGER TERRY RESIGNS

The latest example of the damage done by Chairman Hite and his loyal comrade, Chuck Pride, is the resignation of Roger Terry, Wildlife-Urban-Interface Specialist and Urban Forester.

As the county WUI expert, Roger Terry was very interested in the data we could collect on the feral cats fed and watered at the Cat Care Network feeding station on county annex property. Cat Care Network was invited to collect data and report every two months to Roger, on cat population, health issues, feeding patterns and habits, and population reduction through no-kill, non-violent, trap-neuter-return.

Hite and Pride tried to stop that project, using the Catch 22, “anti-donation clause” argument they trot out every time the fresh breeze of rational action threatens to clear away the smell of arrogance and ignorance that pervades the city and county.

When the county attorney, Robin Blair, pointed out that the feeding station TNR program represented no contravention of any anti-donation clause, then Pride took another run at destroying the feral cat study program, this time using the city’s “six-day law” and “abandonment clause” against the trap-neuter-return, cat sterilization program to curb feral cat population growth in downtown Raton. Hite stated in a telephone conversation last November that the fire marshal and wildlife urban interface specialist “had no business involving the county” in the feeding station project. If anyone had the authority and right to collect and interpret data on population patterns of wild animals in downtown Raton, it was Roger Terry!

For Cat Care Network, the bullying and intimidation started in 2005, when Chairman Hite was planning his takeover. Now that Chairman Hite is in power, the bullying and intimidation is being conducted with insatiable vigor, a dirty political vendetta, with regrettable outcomes for many more parties. Larry Osborn, county fire marshal, who acted as coordinator for the feral cat study program, has been hounded into suspension, Steve Steinberger, county planner, an enthusiastic supporter of the feral cat study project, has resigned. Now, Roger Terry is gone. A triumvirate of progress, professionalism and compassion has been destroyed.

As well, this past January, Chairman Hite turned down the low-cost, mobile spay-neuter clinic funding opportunity from the state, stating, “Stray cats are not a county responsibility”. Disbelief and contempt is how democratic leaders across the state regard the thoughts of Chairman Hite. Most recently, town leaders in the little community of Aztec, in northwest New Mexico, have stated they are introducing their own mandatory, low-cost spay-neuter program this spring, and the state, itself, is introducing a bill next January that will implement a mandatory, low-cost, spay-neuter program, statewide. Why? Because democratic towns and counties across the state have already concluded that denial is not working, cat and dog population is out of control and they need to take responsibility for the problem.

What have Hite and Pride achieved in such a short period of time? Anger, fear, loathing, contempt, resignation, untold dysfunctional outcomes for county safety, county morale, county progress, county solvency, and county reputation in Santa Fe.

Chairman Hite’s latest plunge into the Great Leap Backward is his plan to tear down the county fire safety and awareness web page, trotting out his usual “ anti-donation clause” argument that will keep Colfax county gagged and bound in his backward regime for years to come, if we don’t demand his resignation now.

An Open Letter to the Raton City Manager, City of Raton, Raton City Council, and Raton Municipal Court:

Thank you for your voice mail message of June 29, 2006, stating that Raton City Council opposes any changes to City animal ordinances.

Cat Care Network’s feeding station/trap-neuter-return program can therefore be charged with criminal offenses under the current “six-day law” and “abandonment” clauses.

As well, dozens of law-abiding animal lovers who routinely feed, water, spay and neuter homeless cats and kittens across the city can also be charged under section 5.1 and 5.7 of Raton animal ordinances.

Each sentence can range up to 90 days in jail and each fine can range up to $500.

As you know, Chuck Pride and a few others in the City and County worked tirelessly last winter and spring to block the Cat Care Network trap-neuter-return/feeding station program, using the City’s “six-day law” and “abandonment” clauses.

Earlier, they had tried to block the feeding station/trap-neuter-return program, using the “anti-donation clause” against the County’s exchange of three-square-feet of County property for trap-neuter-return services. That was finally thrown out by the Colfax County Commission.

The City generated a one-sided, autocratic “Agreement” which was basically unsignable [April 12, 2006]. Cat Care Network responded with a request for a straightforward, democratic document among three parties, the City, the County and Cat Care Network [June 7, 2006]. This document has not been read or understood by anyone at City Hall or anyone on City Council.

Cat Care Network is a 501[c] 3 animal welfare organization. To verify its status, you have my permission to call Cat Care Network attorney, James LaFata, of Lieuwen, La Fata & Tucker, in Albuquerque.

In light of your voice mail message, and the City’s decision to ignore the June 7, 2006, response, Cat Care Network requests an official letter from the City, on City letterhead, stating the following:

The City and City Council has read and understands the following statements:

[1] Cat Care Network does not have care, control or custody of cats or kittens.
[2] Any incidental control is for the purposes of spay/neuter, presupposing the cat’s immediate release from spay-neuter surgery. Cat Care Network does not have control or harbor for more than six days during the period of spay-neuter. [Any other reading will violate fundamental canons of statutory interpretation.]
[3] Cruelty laws are meant to address City and County residents who truly abandon their animals, not those trying to humanely address the outcome of another resident’s cruelty. Cat Care Network does not create colonies of cats. It cleans them up in a non-lethal way.
[4] It is better to have small groups of sterilized and vaccinated cats than free-roaming, intact cats who are not vaccinated [the current situation without trap-neuter-return].
[5] Feeding is not harboring.
[6] The common understanding of abandonment is the leaving of an animal without adequate provisions for the animal’s care. The “abandonment” clause is directed to residents of the City and County who dump their pets and/or move away and leave their pets behind without shelter, without food, without water, without veterinary care or spay-neuter care of any kind. If an animal is returned to the area where it is being fed, it would be a greater injustice to find that these animals had been abandoned so that no action to spay/neuter would be undertaken by anyone.
[7] The basic premise of Cat Care Network is the opposite of abandonment. It is to provide care for animals already abandoned by someone else.
[8] Cat Care Network’s spay-neuter program provides for the cat’s health, prevents breeding, reduces fighting associated with intact, free-roaming males, and prevents disease through a vaccinating program. Cat Care Network’s trap-neuter- return program includes feeding and fresh water. Abandonment and anti-cruelty laws must not be construed as coming into play in this program of care.
[9] The abandonment statute requires that the caregiver be the owner or have care and custody for an indeterminate period of time. This is not present in any trap-neuter-return program. Cat Care Network exercises custody only for the purpose of taking the homeless cat to the veterinarian, at all times presuming the animal’s return to its territory [typically where the cat was originally dumped or abandoned by a City or County resident].
[10] Public policy in most states, including most recently New Mexico, encourages and promotes efforts to reduce the suffering and death of animals. Public policy in most states does not encourage criminal charges against those trying to help animals. Only in Raton, New Mexico, does this happen.

Here is a sample from New York State, which is typical of most states. State law declares it “to be the policy of New York State that every feasible humane means of reducing the production of unwanted puppies and kittens be encouraged.”

Governor Bill Richardson has just approved unprecedented funding for spay-neuter programs across the state, including trap-neuter-return programs for abandoned and homeless cats and kittens. $400,000 has been set aside for spay-neuter initiatives, such as the one proposed by Cat Care Network for the City of Raton and Colfax County.

Hector Balderas, legislative representative for this area, has written Cat Care Network, stating he will introduce a bill in the next legislative session to get the necessary funding for the introduction of low-cost spay-neuter programs for low-income residents. All he needs from the county is a memorandum of understanding.

By copy of this letter, Mr. Balderas will be informed that such an initiative will incur criminal charges under current animal ordinances.

[11] Any attempt to apply an abandonment statute to Cat Care Network will violate the constitution’s requirement “that a penal statute define the criminal offense with sufficient definiteness that ordinary people can understand what conduct is prohibited”.

Does anyone understand why Cat Care Network will be charged with a criminal offense?

To apply an abandonment clause or cruelty law to Cat Care Network not only makes no sense, it violates the constitution on grounds of vagueness.

PUBLIC SUPPORT FOR AN ORDINANCE TO ALLOW FOR CARETAKING, FEEDING, VACCINATING AND TRAP-NEUTER-RETURN OF FREE-ROAMING CATS THROUGH A MANAGED PROGRAM IN RATON, NEW MEXICO

November 17, 2006

The Common Good recognizes that a process to allow for caretaking, feeding, vaccinating, trapping, neutering and returning of free-roaming cats through a managed program of no-kill cat population management is in the public interest, and shall be adopted and passed by the City Council of Raton, New Mexico.

Section 1: The following Definitions shall be used:
Colony means one or more free-roaming cats, whether managed or unmanaged.
Colony caretaker means a person who provides food, water and/or shelter for free-roaming cats in a managed colony.
Colony caretakers shall not be deemed to be owners or keepers of such animals as these terms are defined in current animal ordinances, and shall not be charged with any offence.
Designee means an organization recognized by Animal Control that uses the trap-neuter-return method of stabilizing and reducing the free-roaming cat population.
Free-roaming cat means any homeless, abandoned, stray, feral or undomesticated cat.
Managed colony means a colony of free-roaming cats that is being fed and maintained by a colony caretaker using the trap-neuter-return method to stabilize and reduce the free-roaming cat population.

Section 2: Managed Free-Roaming Cats
[a] For the purposes of reducing euthanasia rates at local animal shelters and humanely reducing the number of unwanted cats and kittens, the City of Raton recognizes that individual caretakers and designees may:

[1] Trap any free-roaming cat in a humane manner;
[2] Have the cat surgically sterilized, ear-tipped for identification, and vaccinated against rabies by a licensed veterinarian;
[3] Return the cat to the colony caretaker who will maintain the cat as part of a managed colony of free-roaming cats; and/or
[4] Release the cat for adoption if the animal can be successfully socialized, as is the case with kittens;
[b] Any free-roaming cat impounded by Animal Control that bears an appropriate ear-tipping indicating it belongs to a managed colony must be returned to its managed colony unless disease or injury determines the animal be examined by a veterinarian. No free-roaming cat may be impounded for the purposes of euthanasia, unless a veterinarian makes a determination that disease is an imminent threat to public safety, or injury cannot be treated and healed.

Section 3: Colony Caretaker Responsibilities
[a] Colony caretakers and the City of Raton, New Mexico, and its designees, shall abide by mutually agreed on standard guidelines, regarding the provision of food, water, shelter and veterinary care for cats within the managed colony.
[b] A person who violates this section shall be punished as provided in the general penalty section of the municipal code, provided that the fine imposed for the first violation shall not be less than $25, and fines increase with any additional violations.
[c] A colony caretaker may be removed from management of a managed colony in the case of failure to carry out his responsibilities.

Section 4: Misuse of Humane Traps and Damage to Caretaker Property
Any person who uses humane traps for purposes of stealing, molesting, torturing and/or disposing of and killing cats and other animals, and any person who willfully damages feeding stations, shelters and humane traps used by colony caretakers shall be in violation of this city ordinance and be punished according to the severity of the crime.

Section 5: The provisions of this ordinance shall be in full force and effect from and after adoption by the City Council of Raton, New Mexico, and approval of the Mayor.

SERBIA: THE WAR IS OVER BUT THE BRUTAL MASSACRE
OF ANIMALS CONTINUES

(April 2005) During the past several weeks we have been contacted by countless Serbians concerned about the startling escalation of blatant animal abuse in their country. Due to widespread corruption and a "fear factor" regarding retribution that still exists in Serbia, these individuals requested that we tell their story while keeping their identities secret. Following are facts and observations recounted by Serbian citizens to the writers of this article.

Ever since the end of the war, Serbia has been inundated with abandoned street animals, the majority of whom are brutally murdered. Like so many other places in the world, most citizens and civil authorities are not educated in humane animal issues and furthermore, do not care. Sterilization (spay/neuter) is not widely practiced. The animal welfare laws that do exist are not enforced and improving animal welfare is not a priority of Serbian government officials.

While it is understandable that the country is still in transition due to its history of war, Serbian citizens reporting the injustices to us, rumor that ample documentation exists detailing rampant corruption not only among Serbian authorities but even within some of the non governmental organizations (NGOs) purportedly engaged in animal welfare. Thankfully, a small minority of compassionate people are working diligently to bring about positive change for both companion and farmed animals. Obviously and sadly, they cannot do it alone.

Ten years have passed since Serbian hostilities were laid to rest It is absurd and unacceptable to use the war as an excuse for abuse, neglect, indifference and inaction. Yet, torturing, poisoning and brutally killing dogs and cats is still occurring without punishment for the perpetrators of these vicious animal related crimes. The "Serbian scene" is of growing concern to civilized people everywhere. Serbian animal welfare advocates have witnessed brutal trapping methods, the ruthless beatings of dogs to death and poisonings, resulting in agonizing deaths. Hunters wantonly shoot abandoned companion animals for sport.

Our sources estimate that the city of Belgrade savagely destroys about six thousand dogs annually. The city "fathers" hire the ”professional pest" control firm EKOSAN to exterminate the unwanted animals--innocent victims of human animal cruelty. The government claims that humane practices are exercised yet documentation and verbal reports from animal workers details graphic images of dogs in Belgrade’s “OVCA” dog kill shelter being viciously destroyed. So much for official Serbian credibility.

Other Serbian observers report that many of the so called humane societies work in "close" relationship with authorities who advocate destroying the stray animals. Witnesses have observed dogs and cats being destroyed using brutal methods by "dog catchers" to round up the animals. "Workers" at kill shelters lack training in humane animal care and control and legal issues pertaining to animal rights. Witnesses have observed dogs and cats being destroyed using brutal methods within these same "shelters". There are also reports of the "disappearances" of sterilization and euthanasia equipment. Furthermore, documentation is available showing dead dogs, skinned and heaped together -- the victims of a mass execution. All this, in a Belgrade shelter! Is this what the Serbian hierarchy terms humane euthanasia?

Equally as sad and reprehensible is the Belgrade zoo, one of the oldest zoos in Europe. Housing approximately two thousand animals, the zoo has acquired a notorious reputation due to the unacceptable treatment of the animals in their "care". The zoo director has close ties to the Serbian hunting lobby as well as Belgrade’s city hall. Documentation is available from Serbian animal welfare advocates showing these animals confined within squalid living conditions and consequently ill and distressed. Many of these animals exhibit abnormal behavior, such as bar biting, over-grooming, self mutilation, head bashing, circling, leg chewing, etc. Furthermore, many animals that were born in the zoo throughout the years have disappeared. The zoo claimed that new tigers, bears and a hippo were born recently but the animals appear to have vanished.

Put a stop to the brutal, vicious killing of domesticated street animals by government officials, civil workers and ordinary citizens. Please request the aid of international animal welfare organizations who are adept at planning and implementing humane welfare programs. Implement a spay / neuter program throughout the country and attempt to initiate humane education programs in the school system. Request assistance in the design of coherent and straightforward animal protection legislation. Once in place, and so important, implement and enforce that legislation and initiate prosecution and punishment for perpetrators of animal related crimes. If need be, until Serbia is capable of tending properly to her zoo population, extend an invitation to experts in the proper and humane care and management of confined species. Please enter this new millennium with compassion and a civilized stance regarding animal welfare.
